THE DEPARTMENT MAY REQUIRE A PERSON SUBJECT TO THE TAX UNDER THIS ACT TO MAINTAIN AN ANTI-SALES SUPPRESSION DEVICE ON ITS CASH REGISTER, ELECTRONIC CASH REGISTER, OR ANY OTHER POINT-OF-SALE SYSTEM IN A MANNER PRESCRIBED BY THE DEPARTMENT.

On November 13, 2014, State Department of Treasury received the authority to mandate that, for purposes of collecting sales tax, up to 1,000 merchants statewide must install software or detectors to expose the use an “automated sales suppression device” for falsifying the records of electronic cash registers (also called “zappers” or “phantom-ware”). The vote was 31 in favor, 5 against, and 2 not voting.
